Remove country caps on EB2, EB3 Green Card aspirants.

WASHINGTON, DC: It’s heartening that in all the imbroglio and limbo over illegal immigration, the US government finally took action after years to help legal immigrants, who form the real backbone of this country: it’s done the right thing by granting work permits, EAD cards, to H4 visa holders, beginning late summer of this year.

It’s apparent that the United States Citizenship and Immigration Services (USCIS) know the value of extending these work permits to H4 visa holders. Most of the H4 visa holders are educated, qualified and skilled workers who have been languishing in this country without being allowed to work, for no fault of theirs.
Their only fault, or even negligence, as some may call it harshly: left blossoming careers in their home country or aspirations for higher studies, to get married to somebody settled in the US, who has a good job, but doesn’t have a Green Card.
Here’s what the Director of the USCIS León RodrÃguez acknowledged today about H4 visa holders: “Allowing the spouses of these visa holders to legally work in the United States makes perfect sense. It helps U.S. businesses keep their highly skilled workers by increasing the chances these workers will choose to stay in this country during the transition from temporary workers to permanent residents. It also provides more economic stability and better quality of life for the affected families.â€
The USCIS also made it clear that they very well know the unfairness of it all over the years by not giving EAD cards to H4 visa holders, and how much this act of giving the cards finally will help highly skilled workers, on H-1B visas, and their families, who contribute a lot to the US economy, and make it a dominant force globally:
“DHS expects this change will reduce the economic burdens and personal stresses H-1B nonimmigrants and their families may experience during the transition from nonimmigrant to lawful permanent resident status, and facilitate their integration into American society. As such, the change should reduce certain disincentives that currently lead H-1B nonimmigrants to abandon efforts to remain in the United States while seeking lawful permanent residence, which will minimize disruptions to U.S. businesses employing them. The change should also support the U.S. economy because the contributions H-1B nonimmigrants make to entrepreneurship and science help promote economic growth and job creation. The rule also will bring U.S. immigration policies more in line with those laws of other countries that compete to attract similar highly skilled workers.â€
The question to be asked is why did it take so long for the US government to do the right thing?
But here’s the thing: they have finally done it, and perhaps, this is just the catalyst that was required for further proactive action this year, on the legal immigration front, especially on removing the blockage for Green Cards for applicants from India, who are in EB2 and EB3 status. That action, on removing the country caps, should be the priority for advocates and activists of legal immigration. If that happens, it would go a long way in fixing the broken immigration system, on the legal immigration front.
Also, it’s important that the USCIS make further reforms and give EAD cards to all H4 visa holders, and not just a select few. Right now as it stands, only spouses of those H1B visa holders who have been here for more than six years and got extensions to stay on and work legally, or those who are in advanced stage of their Green Card applications, are eligible for work permits.
But what about those H4 visa holders who are new immigrants, are perhaps brilliant engineers and software programmers, teachers and academics, crave to get back to work? It’s now doubly unfair that they have to see a friend of their, also on a H4 visa, going to work, while they beat their heads against the wall.
The USCIS needs to understand that this is a human rights issue, that by denying work permits to certain H4 visa holders, it creates tremendous turbulence in their lives, wrecks marriages sometimes, puts financial pressure on families as they grow and extend their roots in the country.
And often times, by making H4 visa holders wait for six years or more to receive their Green Cards, they often lose their edge in the professions they had once worked in, or aspired to join. They need training to get back into cutting-edge industries, may not be prepared for the big day. Some may not be competent anymore, so the work permits may be useless.
At least, the USCIS needs to look into giving work permits to H4 visa holders who have been in the country for at least three years. That way, it would give new immigrants on that visa, a chance to even go in for some advanced studies in US colleges and universities to hone their skills and get further academic skills under their belt. They would be assured that they are preparing for a career down the road.
But kudos to the USCIS for finally taking a big, positive step in the right direction. Hope they keep it going.
And hope legislators on Capitol Hill see this, and take action to make further inroads to help skilled immigrants. After all, it helps the US economy too.

Completely agree with you. They should atleast allow those H4 who have been here for 3 years and who are not applicable under the H4EAD rule. Is anyone aware if there is some action going on for this too? Never heard much after the H4EAD news is out.

suprisingly,only about 1,300 dollars out of her monthly income were left from the bills we payed
i can still remember the days when we had to sleep on the floor
in an apartment complex that we were only able to afford because our relatives built it
this apartment complex was full of robbers,kidnappers,killers…..
mom’s college friend,who we all disgust,lied on her resume that she studied for two years(she studied for two months) and got the job
but our family wouldn’t do that
so mom went thru a lot of pressure
if she couldn’t support us we’d all have to leave
back to india
no we don’t have another country to go back to
we had to choose america over our home country to get here
after we came to america
we were trapped
because we couldn’t legally go back to india and work

Why should the U.S. government give anything to H4 scab parasites – and H1B’s, while were on the subject? Why does the American public owe you anything? With this new rule, all IT companies are going to create fake resumes, and send it to clients, with less salary and they get the job. This is going to be big loss for all H1B skilled workers.

Details are still coming in, and this news will be updated later today, but for now, it’s also likely that as many as 179,600 H4 visa holders may be eligible in the first year the cards will be issued, and subsequently as many as 55,000 annually.
The granting of EAD cards has come after three years when it was first proposed in February, 2012. It made little progress till April of last year when the White House issued the guidelines for the cards to be issued. And then came a period for public comments and official procedures. President Barack Obama also made it part of his Executive Action in November of last year. The USCIS finally submitted the final rule for the White House to approve it earlier this month, and which it did.
If one goes by this US govt is getting more money and whopping number of people in job market, especially IT and it will surely have effect on salaries or pay rates going down.
Already I have heard from friends who do consulting that first preference is being given to those who have EAD or GC and then to H1B. Now just imagine what will happen to those H1B holders whose jobs would be taken away by these new H4 getting EAD.
What about spouse of green card holder? if they come as a depandent visa then they will be able to work ?

depends in what stage of GC he is . .only if he is I140 approved will his spouse be eligible to get H4 EAD

I dont agree with you on the point that the H4 EAD should be given to spouses of all H1B immigrants …I think what they have done right now is perfect. with giving EAD’s to only those who have shown commitment in permanently settling here in the US (buying house / investing in the US etc)… Giving out EAD;s to all H4’s will only encourage people coming to the US temporarily (this includes people from offshore IT companies ) and who dont want to make commitments in the US (buying house etc and send all the earned wealth back home. . That doesn’t help the US economy at all. . .US needs immigrants who are willing to be here for long and who want to be part of the american society not the ones who just come here to earn money and send all the capital home..
You seem to have some grave misconceptions. Initiation fo GC itself is a proof that the person is willing to make long term commitment.Its a different thing that it takes so long that person thinks twice. You dont have to buy house in US to show USCIS or govt about your plans. People postpone their plans because the process is slow and they are now sure when that will end. Many people having waited for 15 or more years have sold their homes and left US shores.
Also another point of yours needs some correction and that is about people from offshore IT companies. By my calculation these offshore IT companies would be more happy today. These companies are filing more GC in US than H1Bs. Getting 140 is not a big deal for these companies. Cognizant files in thoushands.
Now wives of these people would come from India( some of these ladies would be working for these IT companies in India) and run away with EAD.
Worst days are coming for sure.
I am happy for only one thing. H1B would be more competitive now. All over the world people would apply in more numbers so that the edge of Indians will go down. Level playing field would come.
No. I tell people from my country who go on-line and ask about an H-1B job, that their wives are treated as garbage in the US. Most of them decide not to take the job-offer.
I was a spouse who came to the US years ago – NOT om India – without knowing what I was in for. Our Green Cards took all-in-all eight years.
Not committed ?! We bought a house, a car, furniture, etc. within the first six months afer arriving ! We had all our books, H.H. goods shipped here. We burned our bridges by coming here.
My husband helped build products that were sold all over the world, earning money for US companies. He helped create employment for USers. He mentord many US workers – who were the able to go on to better jobs.
And I ? I was punished with an H-4 – not allowed to create a life here for myself. I lost my ability to work, to generate money. I lost my self-respect and my health. At home at had good work and also my own little business.
Now I am 65 and have no penny to my name. No Soc. Sec. payments, no premium free Medicare A. I get a letter every months from a US government agency to let me know that I was never welcome here, and a bill for 600 bucks.
I am utterly lonely and afraid for the future. That is what the US does to immigrants who come legally. Stress and loneliness damages people – bring them to their graves before their time.
The new rule means next to nothing. Too many years without employment means you are seen as damaged material, and no one will hire you. Just as it happened to me. H4’s are discriminated against as they are women.
I curse the day my husband was offered a job in this country of small-minded people. If I could afford it I would have gone home a long time ago.

A Green Card takes often 4, 5 years. Employers cannot wait that long, hence the temporary permits like H-1B.
And employers love it that H-1B’s are basically indentured servants. They can use the G.C. petition as a carrot and a stick.
(And when we came it was FORBIDDEN to assimilate into US society.)

Some H-1B’s, working in the most expensive areas of the country, do indeed make $120k+. Most, however, make $60k and below, and are forced to work long hours under the threat of being sent back home if they don’t– never mind the Desi middle-managers who extort a cut out of each paycheck.
At the very least, please get your facts right, instead of throwing out HUGH numbers that you read about somewhere on the internet. (Probably from someone recruiting H-1Bs)

You are completely right with regards to the desi middle managers .. these middle managers are a nuisance to the job industry .. Some thing should be done to fix that ..No disagreement there. . However just to add to that. . its not always that they are desi .. . I have personal experience working with an all american caucasian middle manager working for an american bodyshopping company was way worse than a desi middle manager that i came across .. just my personal experience . .may vary ..

I managed get out of these cheap middle men .. by enhancing my skill set and getting a job where i dont have to depend on these crooks. . .So even the americans as you put it. . .can improve their skill set and do the same. . the only way out is not to depend on these crooks and make them flourish . .

I work in an American owned tech company (NOT in the IT sector) with 20k employees in the US. . in this .. only 10% are employed through these bodyshop vendors. .rest 90% are direct employees of the company .. . Among these full time employees.. .there are around 60% indians. . 25% east asian and just 15% american employees. . . Now why do you think this is the state of demographics ?

Another fact I am sharing…… actual average engineer makes hardly 5000 Indian Rupees (<100) salary in India once they passout from some average engineering schools! They may get more in Computer Science field but may be starting salary for a graduate will be 20,000 Rupees ((~400).Now the same person comes to US and study then work on H1b and gets $5000 on average…………. and still complains! Seriously people you have no right to demand anything here. Get satisfied with whatever u r getting otherwise get out of USA.

Not even close to true. Most foreign workers have “spiced” resumes and imaginary skill sets. They are mostly presented via staffing firms, such that we get the third degree while they get ushered in with little scrutiny.

Your average H-1B will wind up working for a bodyshop, making way less than that, and will never have a shot for a green card.

My husband as offered a job in the US in 1993. He declined, as I had no desire to go to the US. About 6 months later they approached him again – the co. had not been able to fill the position with a USer.
It was not about the money, it was about the knowledge and experience he had. He was not cheaper than a USer.

The H1B visa is to fill positions where they cannot find a qualified worker. The Indian bodyshops have maligned and abused the visa program for profiteering. By your logic, if there is an Indian worker in a position where an American worker becomes available, the position should be vacated immediately by the H1B holder and the American takes over the job. There is PLENTY of skilled labor in the US. We created the IT sector, the PC, the internet, etc. Dont be mistaken. Lastly, the H1B visa is NOT an immigration visa. It is for temp workers. And knock it off with the silly native immigrant arguments. It makes you look desperate.

If there are plenty of skilled labor in the US . .what are they doing sitting on their *** unemployed ? .. 1. Companies like Infosys, TCS, Wipro, HCL would be having a good laugh today.

3. Companies like those stated above are already gaming the green card process by filing in bulk which makes getting 140 is peace of cake. Then ladies can marry these 140 holders get EAD and run down job market.
4. It has never been easy for ladies, otherwise they would have to wait for years to get GC in EB3 for themselves. Now they can ride piggy back on a 140 holder and run with EAD.
5. H4 holders could easily study, there was no restriction on going to school but now USCIS has given a channel for mass exodus from all over the world, particularly from India.
6. Poor students who come here for study wait for years dont get any such benefits but ladies on H4 are new gold diggars.

The (real) high tech workers are not your competition – as the employer must proof they do not displace a US workers. They help CREATE jobs for USers.
The real competiton for US workers are the One Million permanent immigrants allowed in every year based on a family connection with a US citizen, or because they won in the Diversity Lottery, or because they got asylum seeker/refugee status.
For those ONE MILLION immigrants there are no requirements when it comes to education, skills, work experience, or command of the English language.

I am sure USCIS is going to tighten 140 approvals now. Very few 140 would be approved.
