The second drug test produced negative result.
The Orlando police have reasons to worry as a man whom they arrested last year after they mistook Krispy Kreme doughnut glaze that he carried in his car for methamphetamine or meth, has now sued the city of Orlando and a drug-testing kit manufacturer.
A report that appeared in the Orlando Sentinel says, Danial Rushing, the man who was arrested by the police on drug charges for carrying meth, a prohibited drug, has decided to take the issue to the court.
In the search operation, police found what they thought were pieces of crystal methamphetamine but it actually turned out to be four tiny flakes of glaze on the floorboard.
Even though Rushing told officers that it was just sugar from Krispy Kreme doughnuts that he just ate, the drug test conducted on him turned out to be positive for using the illegal drug.
A few weeks after the incident, a proper drug test was conducted on Rushing in a state crime lab which proved his innocence, following which the charges leveled were dropped.
The Orlando police have maintained the stand that the arrest was lawful under the circumstances. The paper said the city declined to comment.
