WASHINGTON, DC: The Iowa Court of Appeals has in a reversal of its earlier decision, dismissed an order against nuclear medicine director at the University of Iowa, Michael Graham, brought by former employee Ravi Sood.
The Associated Press reported that the earlier order had required Graham to pay Sood $183,000 for unfairly revoking the clinical privileges of a subordinate.
A jury ruled in 2013 that Graham violated Sood’s constitutional right to due process when he had university hospital staff rescind Sood’s ability to provide patient care without notice or a hearing. Jurors awarded $37,000 in damages to Sood, who said the move destroyed his career in nuclear medicine. A judge later ordered Graham to pay $145,000 in legal fees and costs, the Associated Press reported.
But the appeals court dismissed Sood’s claim, saying he failed to challenge Graham’s decision through available administrative channels.
The Gazette had reported last year that Sood, a former Visiting Associate, had also filed the lawsuit against Graham Dr. Ravi Sood has filed a lawsuit against the University of Iowa and Graham, for an alleged breach of contract and violation of civil rights.
Sood, was hired as a full-time Visiting Associate in July 2008, but during the year period he was hired for, there was a breach in his contract which led to Sood unable to obtain employment since he left in June, according to a lawsuit filed by his attorney David Dutton, of Waterloo, on January 22, 2014, at the Johnson County District Courthouse.
According to the lawsuit, Sood was not provided full-time appointment, had his status from Visiting Associate with billing privileges to clinical fellow without billing privileges, was not paid the promised $100,000 salary, and was not provided full clinical privileges as promised in the contract, the Gazette reported.
