An Indian American man has opened litigation against the San Francisco 49ers and the companies that run the team’s Santa Clara venue at Levi’s Stadium after being viciously attacked by drunken, violent fans last year, claiming inadequate security played a role in the incident.
Kiran Patel, 32, suffered a “severe traumatic brain injury” when he and his cousin were ganged up on by two brothers just before the kickoff of the October 5, 2014, game against the Kansas City Chiefs his attorney, William Smith, said, according to the San Francisco Chronicle.
In addition to Patel’s head trauma, one of the two cousins suffered injuries that put him in critical condition after skull surgery, reported NBC Sports.
The attackers, Amador and Dario Rebollero, were captured on video unleashing a barrage of punches on the Patels.
Following the assault, Amador Rebollero has pleaded no contest to two felony assault charges and was sentenced to five years in state prison. Dario Rebollero pleaded no contest to one felony assault charge in exchange for 30 days in county jail and three years of probation.
The lawsuit also alleges that the 49ers were aware that there is a heightened potential for violence at NFL games, even citing the team’s own “pattern of criminal and violent behavior” by players — “a reference to the 49ers recent spate of players facing legal troubles for issues off the field,” according to the San Jose Mercury News.
After the incident, the 49ers issued a statement saying: “We were appalled to see the video of the attack on the victims and salute the Santa Clara Police Department on their quick response that resulted in the apprehension of the two suspects. Maintaining the safety of all stadium guests is our highest priority, and we are dedicated to providing a friendly and welcoming environment for any event held at Levi’s Stadium.”
