The United States Citizenship and Immigration Services (USCIS) have received more than236,000 H-1B visa petitions for the 85,000 visas available for the year, including the 20,000 such visas reserved for students graduating from universities in the country.
The cap of 85,000 H-1B work visas was reached in 5 business days of opening up the process on April 1, The visa which is for three years can be extended for three more years, and gives a shot at permanent residency too.
The USCIS also announced it received more than the limit of 20,000 H-1B visa petitions for foreign students. Those students who don’t get the visa will get another shot at it as their petitions are added to the pool of the 65,000 visas for all.
The USCIS also said in a press release that it has completed the computerized draw of lots that would determine the successful applicants.
On April 9, USCIS used a computer-generated random selection process, or lottery, to select enough petitions to meet the 65,000 general category cap and the 20,000 cap under the advanced degree exemption, also known as the master’s cap.
The agency conducted the selection process for the advanced degree exemption first. All unselected advanced degree petitions then became part of the random selection process for the 65,000 limit, it added.
USCIS will reject and return all unselected petitions with their filing fees, unless the petition is found to be a duplicate filing, it said.
As announced on March 16 this year, USCIS will begin premium processing for H-1B cap cases no later than May 16. It would continue to accept and process petitions that are otherwise exempt from the cap.
